How We Obtain Your Information  

We obtain and store your information when you provide it to us by signing up for our emails; purchasing a program, product, or service; participating in an event or promotional activity, such as games of chance and competitions; completing a survey or questionnaire; or interacting with us (or our content) in person or electronically, including through email, text message, or social media.   

We use cookies and pixel tags to learn more about how you interact with the Sites and Services and to improve your browsing experience. Our Sites are unable to respond to “do not track" signals. If you wish to not be tracked while visiting our Sites, please browse incognito or decline our use of cookies.  

We also collect information about you from other sources and may combine it with the information you provide. You agree not to provide any information/content - including images, video or other content - that is inappropriate, offensive, or illegal.  

Information You Provide About Others

We do not knowingly collect information from children under the age of 13 without the consent of a parent or guardian authorized to give permission. Such information will be deleted if it comes to our attention that it was received from a child under the age of 13.

• QR code use

We use the information we collect to customize our Sites and Services; to send you updates about your use of the Sites and Services, your purchases, or your participations in an event or game of chance; to market our programs, products, and services; to provide a more seamless experience for you when using the Sites (such as remembering your login or checkout preferences) and Services; and to track, analyze, and improve your experience using the Sites and Services. We may use the information we collect to feature athletes and build a public-facing profile of the athlete. 

When we communicate with you or market our programs, products, or services to you, we may do so through a number of channels, including but not limited to email, digital and print advertising, retargeting, cell phone text messages, and push notifications.

Confidentiality of Your Information  

We take the privacy of the information you provide seriously and protect it securely using all reasonable measures to do so.  

Third-Party Vendors   

We use third-party vendors and hosting companies for a variety of purposes in relation to the Company and its activities, including but not limited to running the Sites; invoicing, collecting, and tracking payments; analyzing website traffic; retargeting and deploying advertising; hosting events; and more. We take reasonable precautions to ensure secure transmission of your information for such activities, however, provide no guarantees that any data provided over wireless transmission or the Internet or stored electronically is fully secure. By transmitting information to the Company via your use of the Sites and Services, you acknowledge that you are doing so at your own risk.

Other Program, Product, and Service Users  

If you give your permission for us to do so, we may share the information you provide with other users of the Company’s programs, products, and services. For example, in connection with a service or product for which the intent purpose is to raise visibility of the athlete.  

Legal Matters  

In cases where the provision of your information is required in order to comply with applicable laws and regulations, or necessary in connection with other legal matters or investigations, we will do so.   

Sale or Business Transactions of the Company  

Should the Company be acquired by, merge with, or participate in a joint venture with another entity, the information you provide and that we collect about you is considered part of the Company’s assets and may be provided to such entities as part of the sale or business transaction.   

Your Rights and Opting Out  

All users of the Sites and Services, regardless of the U.S. state in which they reside, may exercise the following actions:  

• You may contact us to request whether and what personal information of yours we are collecting or processing, how we collect it, how we use it, and who we share it with.  
• You may request a correction to any personal information we have collected from you that is inaccurate or out of date. 
• If you no longer wish to receive our marketing emails, you may opt out through the unsubscribe links included in our emails or messaging. Even if you opt out of emails, we will continue to send emails and other communications related to your account, specific purchases or transactions, participation in events and games of chance that you sign up for, or in response to your inquiries.  
• You may opt out of targeted advertising that may appear on social media or other websites you browse by changing your preferences and settings on those sites.  
• You may also request to withdraw your consent for use of your information by us, to limit the use and disclosure of sensitive information collected about you – including opting out of the sale or sharing of your personal information, or to delete your personal information from our system and that of our service providers. This may, however, limit your ability to participate in programs, products, or services that require such information for the purpose of participation. Your information will be handled as requested unless we are required to do so otherwise by law.  In addition, we may keep and use de-identified, anonymized or aggregated data for statistical analysis and reporting and other purposes.  

You will not be discriminated against in any way should you exercise any of the rights above. 

Our Right to Make Changes  

We may at any time and for any reason change, suspend, or terminate our Sites or Services without prior notification or liability to you. We may change this Privacy Policy at any time by posting updates to the Privacy Policy on our Sites. We may include a notice on our Sites or notify you through email or push notification. Your continued use of our Sites or Services after such changes indicates your acceptance of the new Privacy Policy.   

General Provisions  

If any part of this Privacy Policy is illegal, invalid, or not enforceable, it will not affect the legality and enforceability of the rest of the parts. This Privacy Policy is effective as of the date below.
